Terms of Service

Overview

These Terms form the agreement for use of the Shopify-hosted storefront operated by Bushwick Kitchen. "Services" includes the site and all offered content, products, functions, features, and tools; "we," "us," and "our" identify Bushwick Kitchen. Every kind of user accepts both this agreement and the Privacy Policy by entering, using, or buying through the store. A person who does not agree must stop. Future functions remain subject to the operative version.

Section 1 — Access and account

Only a person who has reached the local age of majority may use the Services, subject to consenting to a dependent minor's use on a device the person controls. Information needed for browsing or purchase—including email and billing, shipping, or payment details—must be truthful, current, complete, and provided with proper rights. You bear responsibility for credential security and all account actions; account assignment, licensing, sale, or transfer is forbidden.

Section 2 — Products

Although care is taken with product photographs and colors, screen characteristics prevent a guarantee of accurate reproduction, and the item received may look or feel different from what was expected. We can update a description, change or stop an item, and restrict sales or quantities by customer or location without notice. Prohibited offers have no effect. Satisfaction with products, services, information, and error correction is not warranted.

Section 3 — Orders

Your checkout submission constitutes an offer. It is not accepted until Bushwick Kitchen sends confirmation after payment receipt and processing, and we may decline for any reason. Because post-acceptance cancellation cannot be assured, verify the order carefully. We endeavor to communicate any refusal, change, or cancellation using the contact or billing information given. Quantity restrictions or cancellation may cover the same individual, household, account, credit card, address, dealer, reseller, or distributor. Orders are personal or household purchases and the Refund Policy controls returns.

Section 4 — Prices and billing

The applicable price is the one current at checkout and listed in the order confirmation, even though prices, deals, and promotions can change without notice. Unless an express statement says otherwise, shipping, handling, tax, customs, and import costs are not included. Other stores or channels may use different pricing. Specific promotional conditions override inconsistent general Terms. You agree to provide and promptly update complete and correct purchase, account, email, and payment details.

Section 5 — Shipping and delivery

Delivery timing cannot be promised; all dates are approximate, and we accept no responsibility for delay arising from shipment providers, border processing, or uncontrollable events. Once the merchandise is delivered to the carrier, risk of loss and title move to you. You must satisfy destination tax, duty, customs, and related requirements.

Section 6 — Intellectual property

All intellectual property embodied in the Services—such as branding, trademarks, text, reviews, photos, artwork, audiovisual material, design, organization, and compilation—is owned by Bushwick Kitchen, an affiliate, or a licensor and protected by law. You receive a narrow personal, non-commercial usage privilege. Copying, alteration, distribution, publication, performance, display, storage, transmission, derivative creation, licensing, sale, or exploitation needs advance written permission. No patent, trademark, copyright, or other license arises by implication.

Section 7 — Optional tools

Third-party optional tools can appear in the Services, but we neither monitor nor direct them. We provide access without warranties or representations, on an "as available" and "as is" basis, and disclaim endorsement and responsibility for their use. You alone decide whether to use them after accepting the provider's conditions. Any newly introduced Service tool or feature is governed by these Terms.

Section 8 — Third-party links

A link can take you to an unaffiliated third-party site, and third-party material may be presented. We make no representation after reviewing—or without reviewing—its correctness, practices, goods, services, or other content, and bear no liability for resulting harm. Before conducting an external transaction, study its terms. Questions, claims, and complaints belong with the third party.

Section 9 — Shopify relationship

Although Shopify supplies the commerce technology, all goods are purchased from Bushwick Kitchen, not Shopify. Responsibility for products and transactions does not transfer to Shopify. You release Shopify and affiliated entities from every claim, injury, loss, damage, or liability associated with an order placed with us.

Section 10 — Privacy

See the Privacy Policy for the rules applying to personal information. Hosting by Shopify means that Shopify gathers and processes usage or access information and may move it outside your country. The relevant store and Shopify privacy notices both apply to their respective processing.

Section 11 — Feedback

Feedback—including ideas, plans, reviews, recommendations, and proposals—carries a perpetual global, no-royalty, sublicensable license allowing us to copy, adapt, publish, distribute, display, and use it for any purpose or medium, including commerce. No duty of confidentiality, payment, or response arises, and moderation is permitted. The submitter warrants against infringement, illegality, libel, abuse, obscenity, malware, impersonation, and source deception and accepts sole responsibility for truthfulness.

Section 12 — Errors, inaccuracies, and omissions

The Services may include an omission, inaccuracy, or typographical mistake in product details, prices, deals, offers, shipping cost or timing, and stock. We reserve the right at any time to correct, alter, or cancel an affected order, including a submitted order, without notice. No routine update obligation exists beyond legal requirements, and an update marker does not imply a comprehensive revision.

Section 13 — Prohibited uses

Do not employ the Services to break law, harm or deceive others, infringe rights, harass or discriminate, publish falsehoods, transmit unsolicited messages or malware, gather personal data without authority, phish, pharm, pretext, crawl, scrape, or defeat safeguards. Access or extraction by robot, automated system, or artificial intelligence and commercial reproduction or resale are also barred. We can end or suspend use when these restrictions are violated.

Section 14 — Agents

Using software or another agent to reach the Services on someone's behalf requires valid authorization to accept these Terms for that person. The agent must transparently declare its status and accurately identify itself and its contact. It must not defeat CAPTCHA, rate limiting, robots directives, or other controls, imitate a human to hide automation, or give a false purpose. These Terms apply, and access can be disabled.

Section 15 — Termination

These Terms stay in force until either party terminates them. Stop using the Services or communicate that decision to terminate on your side. We may terminate without prior notice if a breach is believed or suspected and can deny further access. Existing financial and other liabilities through the effective date continue, as do all provisions whose character calls for survival.

Section 16 — Disclaimer of warranties

The Services contain general information that is not guaranteed current, complete, or correct, and you accept the risk of relying on it. Unless applicable law prohibits the disclaimer, every product and Service is furnished on an as-is, as-available basis without warranties or conditions, whether express or implied, including merchantability, merchantable quality, particular-purpose fitness, durability, title, and noninfringement. Operation and results are not promised to be uninterrupted, timely, secure, accurate, or error free, and availability may end without notice.

Section 17 — Limitation of liability

Bushwick Kitchen and all affiliated companies, officers, directors, workers, agents, contractors, suppliers, service providers, licensors, Shopify, and Shopify affiliates exclude liability as far as law permits for damages of every type—direct, indirect, incidental, special, punitive, exemplary, or consequential—such as lost revenue, profit, savings, data, or replacement costs, relating to products, Services, or external content. The exclusion applies under contract, tort including negligence, strict liability, and any other theory even after warning. Mandatory law reduces the exclusion only to the extent required.

Section 18 — Indemnification

You must hold harmless, indemnify, and defend Bushwick Kitchen and Shopify, plus both groups' affiliates, partners, directors, officers, employees, agents, contractors, licensors, service providers, subcontractors, and suppliers, against third-party claims, damages, liabilities, losses, and reasonable attorney costs caused by use, a Terms or incorporated-document breach, illegality, or rights violation. Notice will be supplied unless a delay is not materially prejudicial. We can control the defense or settlement, cannot impose a nonmonetary settlement duty on you without permission, and you must assist.

Section 19 — Severability

When a provision cannot lawfully be enforced, the enforceable portion remains effective and the invalid portion is removed. That determination does not affect the validity of the rest of these Terms.

Section 20 — Waiver and entire agreement

No right or provision is surrendered by a delay or failure in enforcement. The Terms plus incorporated store policies and operating notices represent the whole agreement governing the Services and displace every previous or concurrent proposal, conversation, or agreement in oral or written form. Unclear wording is not automatically read against its drafter.

Section 21 — Assignment

No user assignment, delegation, or transfer of rights or obligations is valid unless we first consent in writing. Bushwick Kitchen may assign or transfer the Terms and its duties or rights without seeking permission or giving notice.

Section 22 — Governing law

Any Service agreement, including these Terms, is interpreted under the substantive law where Bushwick Kitchen maintains its headquarters, without applying conflicts rules. The parties submit to venue and personal jurisdiction in the federal and state or territorial courts located for that area.

Section 23 — Headings

The headings help organize the agreement; they neither restrict nor change any provision.

Section 24 — Changes to these Terms

This page provides the operative Terms for review. We can amend, update, or substitute provisions by publishing the new text, while users are responsible for periodic checking. Legally required notice accompanies a material revision, which begins on the date identified. Continued Service access after publication accepts it.
